باستخدامك لتطبيق Rakeb / راكب (“التطبيق”) أو بوابة الويب https://rakeb.me (“البوابة”) أو بإنشائك حسابًا عليهما، فإنك تقرّ بموافقتك على هذه الشروط والأحكام (“الاتفاقية”). إذا لم توافق على أي بند، يرجى التوقف عن الاستخدام.

يُرسل الراكب طلب حجز، ويُعدّ مؤكدًا عند قبول السائق عبر التطبيق.

قد تفصح الشركة عن معلومات متاحة حول الراكب –بما فيها بيانات شخصية– للجهات المختصة عند الطلب ووفق القانون، أو لحماية حقوق الشركة أو المستخدمين أو السلامة العامة.

11) متاجر التطبيقات

Apple وGoogle ليسوا طرفًا في هذه الاتفاقية ولا يتحمّلون مسؤولية التطبيق أو محتواه. يلتزم الراكب أيضًا بسياسات وشروط متاجر التطبيقات ذات الصلة.

12) القوّة القاهرة

لا تُعد الشركة مُخلّة بالتزاماتها إذا حال دون التنفيذ ظرف خارج عن الإرادة (مثل الكوارث الطبيعية، الاضطرابات، الأعطال العامة، أو القرارات الرسمية) بما يتوافق مع القوانين النافذة.

13) القانون الحاكم وتسوية المنازعات

تخضع هذه الاتفاقية وتُفسَّر وفق قوانين المملكة الأردنية الهاشمية، ما لم ينص القانون الإلزامي خلاف ذلك.

تُحلّ المنازعات وديًا خلال 30 يومًا من الإخطار الخطي. وإن تعذّر، تُحال إلى تحكيم ملزم في عمّان، الأردن لدى مركز تحكيم معتمد في عمّان وفق قواعده، ويكون حكمه نهائيًا وملزمًا.

عند التعارض بين النسخة العربية وأي ترجمة، يسود النص العربي ما لم يفرض القانون خلاف ذلك.

14) التعديلات

يجوز للشركة تعديل هذه الاتفاقية بنشر النسخة المحدَّثة على البوابة أو التطبيق، ويُعدّ استمرار الاستخدام بعد النشر موافقةً على التعديل. سيتم تحديث تاريخ “آخر تحديث” في أعلى الصفحة.

Terms & Conditions for Passengers

By accessing the Rakeb / راكب mobile applications (“App”) or the https://rakeb.me website (“Portal”), or by creating an account, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.

1) Definitions
  • Passenger: An individual at least 18 years old who creates an account and uses the Services to request or book rides.
  • Driver: A user who offers a ride through the App and contracts directly with the Passenger.
  • Services: The Company’s technology platform that enables discovery, matching, and booking of rides, with related communication and payment features.
  • Personal Data: Any information relating to an identified or identifiable natural person.
2) Nature of the Service
  • The Company provides a technology platform only. It is not a transport company, does not provide vehicles, and does not employ drivers.
  • Any ride agreement is concluded directly between Driver and Passenger.
  • The Services may include third-party integrations (maps, payments, notifications, etc.). The Company does not guarantee third-party availability or quality and is not liable for their acts or omissions.
3) Account Creation & Verification
  • An account is required to access most features.
  • You must provide accurate, complete information and keep it updated; you are responsible for safeguarding your login credentials and for all activity under your account.
  • The Company may request identity/phone verification and may suspend or terminate accounts (without notice) for violations of law or these Terms, for misleading information, or if your actions expose the Company or others to risk or liability.
4) Privacy & Data

Processing of Personal Data is governed by the Privacy Policy available at: https://rakeb.me/privacy, which is incorporated by reference into these Terms.

  • Location data (GPS) may be collected during use and sometimes in the background to enable core features (matching, route display, safety).
  • You consent to receiving push notifications and in-app messages related to bookings and service updates.
5) Booking, Pricing, Payments & Cancellations

Booking

Your ride request is confirmed when the Driver accepts it in the App.

Pricing & Service Fees

  • Prices are shown before completion and may include service fees and/or applicable taxes.
  • The Company may update pricing or fee logic from time to time.

Payment Methods

  • Payments may be made in cash, via in-App wallet, or via supported payment gateways, as indicated within the App.
  • Gateways may store payment tokens under their own policies; the Company does not store full card numbers.

Wallet

  • The in-App wallet balance is for use only within the App; it is not a bank account and bears no interest.
  • Refunds, withdrawals, and deductions are subject to Company policies communicated in the App or on the Portal.

Cancellations & No-Shows

  • Passenger cancellations follow the policy presented at booking and may incur fees.
  • If a Driver cancels, you will be notified and any amounts will be handled under the applicable policy.
  • No-shows may be charged as per the cancellation/no-show policy shown in the App.
6) Acceptable Use & Conduct
  • You must not misuse the Services (e.g., illegal/abusive/misleading content; IP infringement; unauthorized advertising/spam; malware; security circumvention).
  • You must comply with safety rules and traffic laws, wear a seatbelt, and refrain from carrying illegal or hazardous items.
  • Harassment, discrimination, or hate speech against Drivers or users is strictly prohibited.
  • The Company may remove content and/or restrict accounts that violate these Terms or applicable law.
7) Passenger Content
  • You warrant that you own or have rights to any content you submit (reviews, comments, photos) and that it does not violate law or third-party rights.
  • You grant the Company a worldwide, non-exclusive, sublicensable license to use, display, and operate such content within the Services.
8) Intellectual Property
  • The Portal, App, and all components (code, designs, text, logos) are owned by the Company and/or its licensors.
  • You are granted a personal, non-exclusive, revocable license to use the Services as intended.
  • Reverse engineering, copying, resale, or use outside the scope of this license is prohibited.
9) Warranties & Liability
  • The Services are provided “as is” and “as available”, without warranties except to the extent required by law.
  • To the maximum extent permitted by law, the Company is not liable for indirect, consequential, or punitive damages, loss of profits, or acts/omissions of third parties (including Drivers, payment providers, map providers).
  • Liability Cap: the Company’s total liability to you for any claim arising out of the Services shall not exceed the total service fees you paid to the Company in the three (3) months preceding the event giving rise to the claim.
10) Cooperation with Authorities

The Company may disclose available information about you, including Personal Data, to competent authorities upon lawful request, or to protect rights, safety, or the public interest.

11) App Stores

Apple and Google are not parties to these Terms and bear no responsibility for the App or its content. You must also comply with the respective app-store terms.

12) Force Majeure

The Company is not in breach if performance is prevented by events beyond its reasonable control (e.g., natural disasters, unrest, widespread outages, governmental actions), in accordance with applicable law.

13) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, unless mandatory local law provides otherwise.

Disputes should first be resolved amicably within 30 days of written notice. If unresolved, they shall be submitted to binding arbitration in Amman, Jordan, administered by an arbitration center in Amman in accordance with its rules. The arbitral award shall be final and binding.

In case of inconsistency between Arabic and English versions, the Arabic text prevails unless local law requires otherwise.

14) Amendments

The Company may amend these Terms at any time by publishing the updated version on the Portal/App. Continued use constitutes acceptance of the changes. The “Last Updated” date will be revised accordingly.

15) Final Provisions
  • These Terms constitute the entire agreement between you and the Company regarding use of the Services, superseding any prior understandings on the same subject.
  • Severability: if any provision is invalid, the remaining provisions remain in effect.
  • No Waiver: failure to enforce any provision is not a waiver of rights.
  • Assignment: the Company may assign its rights/obligations without notice; you may not assign yours without the Company’s written consent.
